Makerere University’s 87th Guild Justice Minister Bbosa Price together with other legal scholars have joined a court petition challenging President Museveni’s take on bail and police bond.
Retired Justice George Kanyeihamba presented the petition to assistant registrar Henry Twinomuhwezi on Monday May 30th, 2022 on behalf of the petitioners.
The petitioners intend to confer with the courts of law about President Museveni’s past remarks on bail and police bond.
Last year (2021) around October, President Yoweri Museveni recommended the removal of police bond and court bail for suspects on capital offences.
Retired Justice Kanyeihamba said president Museveni must withdraw Uganda from all international treaties that guarantee the right to bail.
Justice Kanyeihamba further highlighted that he will advise court to drop the petition and adjourn the matter having learnt that the respondents dropped the utterances.
The respondents through an affidavit of Ms Lucy Mbonye Nakyobe, the Head of Public Service and Secretary to Cabinet, asked court to dismiss the case against the sitting President since he is protected under the law.
Ms Nakyobe further stated that the petition is misconceived and bad in law in as far as it purports to challenge public statements of opinion and recommendations on proposed legislative reforms of the law governing bail, which have not been passed into law.
Bbosa Price said the right to bail is a sacred right determined by the competent court of jurisdiction.
He added that their quest as students to preserve constitutionalism, rule of law and human rights should never cease.
The hearing was adjourned to June 8th, 2022.
