The Grade One Magistrate’s Court in Kanungu, western Uganda has given verdict in a case where a man sued a lady for breaking the marriage promise.
Tumwine Richard sued his relationship partner Kyarikunda Fortunate for breach of promise to marry.
In the suit, Richard further sought for several reliefs including General damages, special damages and costs of the case.
According to court documents, the plaintiff (man) was a teacher at Kiringa Primary School where the defendant (woman) came for teaching practice and the two started love relationship.
They later entered a promise to marry agreement in 2018. The plaintiff financially supported the defendant including sponsoring her for a Diploma in Law at LDC. He spent Shs. 9,439,100=.
On 10th January, 2022, the pair had arranged for an introduction ceremony and a budget was drawn with the function slated for February 2022. The defendant later turned against the plaintiff saying she cannot marry an old man hence the suit.
The court gathered facts regarding the claims which prompted the Grade One Magistrate Mukobi Asanasio to rule as follows;
“The plaintiff prayed for several reliefs in his plaint. I have considered the reliefs sought in view of the evidence adduced in this case. I now order as follow:
- The plaintiff’s suit succeeds. He is entitled to Shs. 9,439,100= Re- imbursement of financial support to the defendant in this failed relationship.
- The plaintiff is awarded Shs. 1,000,000 General damages for inconveniences and psychological anguish.”
The defendant, Kyarikunda Fortunate, is yet to respond to the ruling. She’s however free to take on higher courts of laws for an alternative judgement.
