Campus Bee has received and read a ruling notice from the registry of the Mukono High Court regarding the case of Yasin Ssentumbwe Munagomba and Simon Semuwemba Versus Uganda Christian University that was issued on 8 January 2018, Monday.According to the notice, the Mukono resident judge of the court, Lady Justice Margaret Mutonyi will be delivering her decision of the case next week on the 17 January 2018 (Wednesday) at 9:am
The two students sued the university early last year after they were expelled from the university under allegations that they offered leadership to a demonstration that sought to challenge what they called “illegal” tuition increment by the authorities of the Christian based institution.
In the session that took place on the 2 November 2017, the judge when adjourning the case after hearing the oral submissions of both sides, mentioned that she was to be delivering the ruling of the case on the 21 December 2017. However, it did not happen.
On the day for the intended delivery of the ruling, both sides were represented in the court. The judge was not however able to deliver her ruling due to the delays in filing the written submissions by the university.
“The Judge said she would be delivering the ruling on notice” said Yasin. This implies that the date for the ruling is no longer certain until the judge notifies the parties that she is ready to make her ruling. The date has now been set, and the ruling is ready.
“I have a feeling this case is going to drag throughout 2018 too” predicted Yasin. He is not however moved by the extensions of time. He adds that as the case prolongs, the stronger he gets.
“I am more than strong to fight on that the day when the university first handed me the paper of dismissal. I am not moved by the extension of time.”
When asked if the ruling would be in their favour, Yasin smiled and said he was very hopeful.
“There is hope for us to succeed”
The delay to conclude the case leaves the future of these two students hanging in balance. The case that has dragged on for nearly 2 years now has seen these students struggle for their future, the fate of their education is yet to be certain.
