Makerere University’s Vice Chancellor Professor Barnabas Nawangwe, together with the university secretary Yusuf Kiranda and Ivan Tenywa have been dragged to court.
The trio is accused of spearheading the eviction of Katanga residents contrary to a court order that halted the eviction.
Pastor Daniel Walugembe of Eternal life Gospel church through his lawyers filed a case on July 7 challenging the eviction.
Pastor Walugembe accuses the university for unlawfully demolishing his perimeter wall, garage and property of his residents.
“The demolition altered the status quo in favour of the respondents (accused parties) and if the status quo is not restored, the applicant shall be put at a disadvantage of proving possession and occupation of the suit land in the pending cases,” part of the complaint reads.
Pastor Walugembe wants the accused (Professor Nawangwe, Mr Yusuf Kirunda and Mr Tenywa) to pay UGX300 million as compensation for the damages.
Court had earlier halted the eviction of over 50,000 occupants that occupy the land in question.
“A temporary mandatory injunction be issued restoring the status quo on land comprised in freehold register 59 folio 21 Kyadondo land at Katanga valley as was preserved by a temporary injunction issued by this honourable court on March 7,” the court documents read in part.
According to Pastor Walugembe, he acquired the land from his predecessors and the land has been in good use since 1997.
