It was a comical environment around Judge Lydia’s chambers as the Nkumba University counsel; Mr Luswata showed the greatest instincts on amateurism in the law profession.
His feeble defence submissions last week left people wondering whether Mr Luswata ever touched law school or did the university pick up some cleaner to represent it at court.
At 9.30am behind the his lordship Judge Lydia’s close door chambers in the presence of the suspended student’s counsel Mr Ssemekadde, university counsel acknowledged the university’s shortfall in this matter and therefore lifted the suspension.
This was after one Nickson Twesigye questioned the stature of the so “professor” who appended his signature on the letters therefore also ruling the issued suspension letters illegal too.
University counsel continued to display his miniature levels of professionalism when he appeared before Judge Lydia for the injunction hearing still unprepared. After submission by the student’s counsel seeking an injunction, disoriented counsel Luswata was awarded chance to represent his submission.
Luswata fumbling right now, sought for more time to prepare his defensive paper work. However the wise judge declined his request on ground that an injunction didn’t require any lots of preparation. Moreover she had granted both the prosecutor and defensive sides time to prepare previously.
The university’s counsel was again at it with his clumsiness when he ignorantly questioned the existence of UNSA (Uganda National Students Association) as a professional body. He received abuses from the crowd and lecture from the lady justice who asked him if he was aware of the UNSA constitution that is reflected upon in the Education Act.
“The act stipulates that UNSA shall be responsible for all students in Uganda.” The Judge said.
A public nuisance he had now become, university counsel Luswata was heard lamenting in the court’s chamber corridors how the university doesn’t consult them before making frivolous decisions like these.
The case was adjourned to 27th January today at 3pm when lady justice Lydia will be expected to make her final ruling on the temporary injunction.
