Mkaerere University council has today been served with a legal document from Kamulegeya & Co. Advocates denouncing the illicit suspension of several students. The plaintiffs were temporarirly dismissed from the university on grounds of engaging in a protest against online lectures this week.
“We represent Mr. Mutyaba Idd Reg. No. 20/U/15103/Eve, Mr. Higenyi Abdulfatah Reg. No. 19/U/29163, Mr. Mugisha David Reg No. 19/U/11654/PS, Mr. Kato. Enoch Reg. No. 19/U/0693, Mr. Nuwagaba Aloysius Reg. No. 19/U/17706/PS, Mr. Asiimwe Francis, Student No. 1900700504, Mr. Ayebazibwe Philimon, Mr. Matovu Mathew No. CM01024108JYTA, Mr. Mukisa Joseph Reg. No. 19/U/0876, Mr. Abeneitwe Manful Reg. No. 17/U/1968/EXT, Mr. Turyahabwe Wicliff Reg. No. 19/U/4922PS, and Mr. Bbosa Edrine Price Reg. No. 1900720293 who are students of Makerere University in different Academic years,” the legal notice read.
“On 8th February 2022, the Vice Chancellor arbitrarily suspended our clients over trumped up, baseless and unfounded allegations without following due process and according them a fair hearing. The actions complained of above are unconstitutional, biased, ultra vires, illegal, highhanded, oppressive, irrational, unfair and impinge on a bundle of our clients’ constitutionally guaranteed rights under Articles 20, 28, 29, 30 and 42 of the Constitution of the Republic of Uganda, 1995,” the letter added.
The notifying law firm represented by Counsel Byansi Henry went on to demand for the immediate and unconditional revocation of their clients’ suspension letters.
“Take notice therefore, that we have instructions to demand, that the University immediately and without further ado, unequivocally revokes the impugned suspensions within forty eight (48) hours of this letter, but at any rate, not later than 11th February 2022, failure of which we shall institute in full throttle, the legal machinery against the University at its own peril, embarrassment and heavy cost,” Byansi noted.
The notice became more spicy with a warning to the university council to act as soon as possible as Byansi wrapped up the writing with this;
“Stand warned and expect no further communication from us.”
By time of this publication, no response has been received from the management of Makerere University.
