The High Court has today Thursday, October 4th cancelled the bail it had earlier granted to a YMCA student, Brian Isiko who is accused of sending love messages to Sylvia Rwabwogo, the Kabarole District woman MP.
The decision was intended to make sure that Isiko gets a fresh trial as demanded by his lawyers. Justice Jane Frances Abodo ordered that Isiko should be taken back to Buganda Road Magistrate’s Court for a fresh trial on offences of cyber harassment and offensive communication within 48 hours.
One of the recommendations given in Isiko’s re-trial is that he should be explained the offences and ingredients to him in a language that he understands better before recording his plea.
Justice Abodo earlier trashed Isiko’s conviction including the two-year jail sentence on grounds that the trial magistrate illegally changed his plea of not guilty to a plea of guilty without following proper procedures.
According to the records presented before the High Court, Isiko had first pleaded not guilty to the offences he was accused of until when MP Rwabwogo delivered a testimony, he suddenly admitted to having sent love messages to the yummy looking MP.
As we earlier reported, Isiko said that he wanted the MP for a friend to help him advance his poultry business.
Despite the cancellation of Isiko’s bail, his lawyer Ramathan Waiswa welcomed the High Court’s ruling as he vowed to file a production warrant for Isiko to obtain bail tomorrow (October 5th).
