The Registrar of the High Court Civil Division, His Worship Alex Ajiji has set 6th April as the date on which he will deliver the ruling on an application seeking to temporarily halt the conducting of a re-election at Makerere University’s College of Education until the main case challenging the tribunal ruling that nullified Bazil Mwotta’s election as the 2016 guild president of Makerere University is determined.
This follows submissions by Mr. Bazil Mwotta’s Laywer Counsel Victoria from Mbidde & Co. Advocates; Makerere’s lead lawyer in the matter Counsel Wamala, and Mr. Ssembogga’s lawyer, Counsel Isaac Ssemakadde of Centre for Legal Aid.
During her arguments, Counsel Victoria submitted that her client would suffer irreparable harm which can’t be compensated for in damages if a re-election is held at the College of Education but this was countered by Counsel Ssemakadde who submitted that the applicant had not shown any proof of the said harm, and that his lawyer had submitted on the wrong grounds upon which the interim injunction may be granted.
Counsel Ssemakadde added that in any case, even the ground on which the applicant had sought an injunction, namely, that he had not been given enough time to prepare for the election, can no longer stand as he has now had over one week to prepare, which time any diligent candidate should certainly have put to use.
On his part, Counsel Wamala argued against granting the application, saying that the university’s activities would be grossly interfered with.
After close to three hours of hearing the lawyers’ arguments, the Registrar set 6th April at midday as the date on which he will deliver his ruling to either stop the re-election or not.
