Lady Justice Lydia Mugambe of the High Court, on Monday this week, released a ruling in an application for judicial review that was filed against the Law Development Centre (LDC), in the case of Muhereza Mike Kirungi and Bakesi Jasper Mutalemwa Versus LDC.
In the decision whose highlights were published on Campus Bee reveals the fate of the applicants. The suit was dismissed in favour of LDC.
The Management Committee of the LDC yesterday released a press statement regarding the decision.
In the statement, LDC reveals that the Committee sat on the 10th December, in light of the decision and is now exercising its powers in “conformity and compliance with the said ruling”.
It has nullified the 4th term examinations that were sat by the 80 students (applicants and other affected students)
Below are some of the highlights from the statement.
“The nullified 4th term examinations sat by the applicants and other affected students (80 in total) as a result of an interim Court Order in the above case that has been declared by Court to be “of no consequence” is cancelled with immediate effect and the withheld results are expunged from the official records of LDC” it reads.
Regarding the issue of refunding the money paid to resit those exams as court had ordered, LDC says that the affected students may “apply to LDC for refund of the repeating fee paid OR request that the money be used towards any fee obligations for repeating the subject in a subsequent Academic Year”.
It also adds that those students who intend to repeat the failed subjects can only apply in the academic year 2020/2021 and the applications will only be accepted after they have been made through the normal process “when LDC advertises for the applications”.
The statement further adds that the admissions after application is made is not automatic as “admission to the Bar Course shall be subject to availability of space at LDC”.
“LDC is currently dealing with the challenge of managing large numbers as a result of the suspension of the LDC pre-entry examination in 2019. LDC has to plan for the big influx of pre entry backlog students, new graduates into the profession and students repeating subjects.” It reads.
